Terms of Use

1. Definitions

1.1 "Visible Solution" refers to Visible Solution LLC, including its web platform, mobile applications, and services, developed and operated by Visible Solution.

1.2 "User" means any business entity, client, or authorized representative using the Visible Solution Services.

1.3 "Dashboard" refers to the AI-powered web and mobile app interfaces provided by Visible Solution.

1.4 "Services" include but are not limited to digital marketing, SEO, Google Business Profile management, web development, campaign management, reporting, content automation, and associated analytics functions delivered through the platform and by our support teams.

1.5 "Confidential Information" refers to any business, technical, or financial data shared by either party that is not publicly available.

1.6 "Force Majeure" refers to unforeseeable events outside reasonable control that impact service delivery (e.g., natural disasters, acts of government, internet disruptions).

2. Scope and Acceptance

By accessing the Visible Solution platform or services, users agree to comply with these Terms of Use, our Privacy Policy, and any associated contractual documents (such as service agreements or order forms). These Terms govern all service usage unless otherwise agreed in writing.

3. Services and Access

3.1 Services Provided

Visible Solution offers marketing and AI-powered solutions, including but not limited to:

  • AI-driven Web & SEO Analysis with Optimization Recommendations
  • Social & Local Campaign Management (Google Ads, Facebook, Instagram)
  • Google Business Profile Automation (Posts, Reviews, FAQs)
  • Content Creation & Automation (Web, Blog, Social Media Templates)

Weekly Performance & Growth Reports

Visual Analytics and Predictive Insights

  • Real-Time Optimization and Multi-Platform Campaign Sync

Competitor Monitoring & Customer Segmentation

All features are accessible via the Visible Solution dashboard and mobile applications, supported by our in-house team.

3.2 Usage License

Users are granted a non-exclusive, non-transferable, revocable license to use the platform for their own business purposes. Any resale, replication, unauthorized access, or misuse is strictly prohibited.

4. Account Responsibility

  • Users must maintain the confidentiality of login credentials.
  • All activity under a registered account is deemed authorized by the business entity.
  • Visible Solution is not liable for unauthorized access caused by user negligence.

5. Platform Updates

Visible Solution may:

  • Modify or enhance features at its sole discretion.
  • Roll out periodic updates for performance, security, or improvements.
  • Notify users of substantial changes via email, platform alerts, or documentation updates.

If modifications materially impair a client's intended use, users may request termination within 30 days of notice.

6. Data and Analytics

  • Users retain ownership of their input and generated data.
  • Visible Solution may produce anonymized, aggregated analytics to improve performance, benchmarking, and service quality.
  • These analytics will never identify individual businesses or users.

7. Payment and Billing

  • Services are billed monthly in advance unless otherwise agreed.
  • Time-based or project-based services may be invoiced in arrears.
  • Payment is due within 7 calendar days of invoice issuance.
  • Pricing adjustments may occur annually with 60 days' notice. Users must object within 30 days, otherwise acceptance is implied.

8. User Obligations

Users agree to:

  • Maintain accurate business and contact information.
  • Comply with applicable data protection, advertising, and content laws.
  • Not upload or distribute malware, defamatory material, or unauthorized content.
  • Avoid misuse of platform features for deceptive, fraudulent, or illegal purposes.

Visible Solution reserves the right to suspend or terminate accounts violating these terms without prior notice.

9. Intellectual Property

  • Visible Solution retains all rights to software, processes, templates, AI models, and analytics tools.
  • Users may not duplicate, reverse-engineer, resell, or create derivative works of the platform or its components.
  • Pre-built marketing assets, templates, and analysis reports are provided solely for internal business use.

10. Support and Availability

  • Support hours and communication channels are outlined in onboarding documentation.
  • Visible Solution strives for maximum availability but may schedule downtime for maintenance.
  • Service disruptions due to Force Majeure events are exempt from liability.

11. Confidentiality

Both parties agree not to disclose, copy, or misuse non-public information shared during the business relationship. This obligation survives termination of services.

12. Limitation of Liability

  • Visible Solution is not responsible for indirect damages, loss of profits, or data loss resulting from user-side mismanagement.
  • Direct liability is capped at the value of the annual subscription or contract amount.
  • Claims involving gross negligence, willful misconduct, or regulatory obligations remain unaffected.

13. Term and Termination

  • Contracts automatically renew unless terminated with proper written notice.
  • Upon termination, users must cease accessing the platform.
  • Users may request data exports within 30 days of termination.
  • Visible Solution will permanently delete customer data after the retention period, unless legally required to keep it.

14. Amendments

Visible Solution may revise these Terms with prior notice. Continued use of the platform or services after updates constitutes acceptance. Users are responsible for reviewing changes regularly.
